Liability

Dear Legislator,

Many parents ask, “If vaccines are safe, what are we protecting the manufacturers from?” The National Childhood Vaccine Injury Act of 1986 (NCVIA) removes any liability from manufacturers and doctors should your child sustain a vaccine injury or death. Additions to the vaccine schedule have coincided with an increase in adverse reactions for patients and an increase in revenue for vaccine makers. Vaccine revenues have soared from 510 million in 1985 to 24.3 billion dollars in 2014. (Vaccine Book, 2.0., Blaxill, M. & Olmsted, D.- 2015) Please oppose any legislation that abolishes the personal and religious vaccine exemptions.

As you may know, vaccine choice has become a highly charged political topic. It is likely that you have been contacted by your constituents, or you may have seen the issue discussed during one of the Republican debates. If you missed it, here it is: https://youtu.be/hVHGE_JLQ6I

The CDC vaccine schedule increased significantly after vaccine makers were granted immunity from lawsuits. Below you will find a link comparing the nearly tripled vaccine schedule to the schedule of the 80’s. http://www.cdc.gov/vaccines/schedules/past.html

As a result of the passing of the NCVIA, the injured now must try to navigate a government system called the Vaccine Court. This “court” has no judge, no jury, no public hearing and is not required to follow legal case precedents. The program is funded by taxpayers through an excise tax placed on every vaccine. Below is a link to a list of some of the payouts to vaccine injured from 2006-2014 alone.

To date, over 3.1 billion dollars has been paid out to the injured with a maximum benefit of $250,000 paid out if your child dies. Most Americans are not aware of this under-used “court”. This link will show some injuries that are accepted for compensation. http://www.hrsa.gov/vaccinecompensation/vaccineinjurytable.pdf

Given the risks, it seems reasonable for those who are responsible for the care of a child to also be permitted to make decisions regarding vaccination of their children. Please oppose any legislation that threatens the personal and religious vaccine exemptions. For more information on reports of vaccine adverse reactions, please see https://vaers.hhs.gov/esub/index
